Terms of Service

The terms that apply to buyer accounts, applications, purchases and the way leads may be worked.

Last updated: October 12, 2026

1. These terms, and who you are contracting with

ForgePoint Exchange is a lead distribution service operated by Forge Point Analytics LLC. These terms govern your use of the platform as a buyer of insurance leads and as an applicant for a buyer account.

We are not an insurance carrier, agency, broker or producer, and nothing on the platform is insurance advice, a quote or an offer of insurance. We do not sell policies to consumers.

2. Eligibility

You may hold a buyer account only if you are a licensed insurance professional or a licensed agency in the United States, and you must be appropriately licensed, appointed and authorized for every state and product for which you register demand. You confirm that responsibility when you create your account, and your confirmation is recorded on the account as a licensing attestation.

Eligibility to buy rests on that recorded attestation, or on license evidence where it has been independently verified and both the verification and the source it was checked against are documented on the account. We do not independently verify the license of every buyer, and we make no representation that your licensing has been checked. No account is described on the platform as verified unless such a documented verification actually exists.

Where we do check license evidence, the check is recorded together with the source it was checked against and the person who recorded it. We may decline, restrict or close an account as set out in section 14.

You must keep your license details, licensed states, lines of authority and appointments accurate and current. If your authority changes, expires or lapses, update your account without delay and stop working leads in the states, or for the products, where you are no longer authorized. We may ask you to confirm your authority again, and may require supporting evidence.

3. Accounts

Keep your credentials confidential, and do not share account access with anyone outside your organization. You are responsible for activity under your account.

An agency account is an organization: the owner manages members, roles and permissions. Leads bought by an agency belong to the organization, not to an individual member.

We may suspend, restrict or close an account that breaches these terms, where the authority recorded on it cannot be relied on, where we are required to by law or by a regulator, or where continuing would put consumers at risk. Depending on the circumstances, leads already delivered remain subject to your obligations of confidentiality and lawful use.

4. Buying leads

Leads are bought from a prepaid balance. You fund a wallet in advance, and each exclusive lead delivered to your account is charged from that balance at the per-lead price published for its product. There is no subscription, no minimum weekly commitment, and no catalogue of leads to buy from individually.

Prices are set by the platform and published on the pricing page where a figure has been configured. A product is only offered once a wallet price has been set for it, and the price charged for a lead is fixed at the moment that lead is claimed, so a later price change never alters a charge already made.

You may not attempt to obtain leads outside the authority recorded on your account. Demand can only be registered for the states and products you have confirmed you are authorized to work, and that recorded authority, whether it is your own attestation or documented verified license evidence where available, is what limits the leads that can be matched to you.

5. Volume, and delivery

We do not guarantee any number of leads, any conversion rate, or any sales result. Lead volume depends on real consumer demand in the products and states you selected.

Leads are matched only to accounts that are active, funded for the product, in possession of recorded authority for the lead's state and product, and within their delivery limits. That authority may be the buyer's own recorded attestation, or documented verified license evidence where available. An account whose balance does not cover the product's price is passed over rather than allowed to spend money it does not have, and a balance can never fall below zero.

Automatic exclusive distribution is switched on and off by the platform. While it is off, no lead is matched and nothing is charged, and no lead volume is promised.

Delivery means a lead has become visible to your account in the buyer workspace. Delivery attempts, including any push to a destination you have configured, are recorded, and failures are retried. A lead that could not be handed over has its charge released back to your balance rather than kept.

6. Billing and payment

Payments are made to fund your prepaid balance through our payment provider. By starting a funding payment you authorise that charge, and no other amount can be taken from you: the platform never debits a payment method on its own, and there is no automatic top-up.

A payment is credited to your balance only once we have verified it against the payment provider, and each funding payment is credited once and once only. Where the provider reverses or refunds a payment, the matching credit is reversed.

Your balance is the only limit on what can be charged for leads. If the balance does not cover a product's price, delivery and matching for that product stop until it is funded again.

7. Refunds

Refunds are governed by the Delivery & Refund Policy. A lead that was delivered to your workspace is not refundable, and the money that paid for it is not returned. A lead that was claimed but never handed over has its charge released back to your balance automatically. Refunds of an unspent balance are exceptional, are considered case by case, and are authorized by Forge Point Analytics at its discretion.

Your balance is not a bank account and carries no interest. Closing an account does not by itself entitle you to a refund of an unspent balance.

8. Your obligations when working a lead

You must contact consumers lawfully. That includes complying with applicable telemarketing and privacy law, checking against applicable do-not-call requirements, using only the consent and disclosure evidence recorded with the lead, and honouring any request from a consumer to stop being contacted.

You must not resell, redistribute, publish, share or transfer lead data, or use it to build your own list for resale. Lead data is licensed to your organization for your own licensed insurance business.

You must not misrepresent yourself, the platform, or any carrier, and you must not use lead data for anything other than following up on the consumer's insurance inquiry.

Licensing and compliance are your responsibility. You must hold and maintain every license, appointment, authorization and carrier contract required to solicit insurance in the states and for the products you work, and you must comply with every law that applies to your contact with consumers, including telemarketing, consent and do-not-call requirements. You must not contact a consumer about a product, or in a state, you are not authorized to work.

These obligations are yours, and they are in addition to our own responsibilities. We remain responsible for how consumer information is collected, recorded and handled, for its privacy and security, and for the integrity of distribution, as set out in section 9 (Consumer data), the Privacy Policy and the Delivery & Refund Policy.

9. Consumer data

Consumer information is shared with you so you can respond to a consumer's inquiry. You are responsible for how you store and use it, for keeping it secure, and for complying with the law that applies to you when you handle it.

If a consumer asks us to remove their information and we have already delivered it to you, we may pass that request to you, and you must honour it in your own records.

10. Platform availability and changes

We may change, suspend or withdraw any part of the platform, including products, states, wallet pricing and delivery methods, and we may pause delivery for technical, compliance or capacity reasons. We aim to be transparent about the state of the platform, and switches that affect buying or delivery are shown as closed rather than silently ignored.

11. Intellectual property

The platform, its forms, its software and its branding belong to Forge Point Analytics LLC. You receive no rights in them beyond the right to use the service under these terms.

12. Disclaimers

Leads are consumer-submitted inquiries. Their answers are recorded as given and are not independently verified by us, and a consumer may not qualify for coverage, may not answer, or may have submitted an inquiry they no longer want. We make no warranty about the quality, suitability or outcome of any lead.

The service is provided on an as-is basis, and we do not warrant uninterrupted or error-free operation.

13. Limitation of liability

To the fullest extent permitted by law, Forge Point Analytics LLC is not liable for lost profits, lost business, lost opportunity or indirect or consequential losses arising from your use of the platform or from any lead, and our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim arose.

14. Suspension and termination

Either party may end a buying relationship by switching off automatic delivery and funding the balance no further. We may suspend or terminate immediately for a breach of these terms, for a loss of licensing, or to protect consumers.

We may suspend, restrict or close an account, or exclude it from delivery for particular states or products, where the authority recorded on it is withdrawn, has expired or is shown to be inaccurate, where license evidence we hold no longer stands, where we are required to by law or by a regulator, or where continuing would put consumers at risk. We may require a fresh confirmation of authority, or supporting evidence, before an account is restored.

15. Governing law, and changes to these terms

These terms are governed by the laws of the state in which Forge Point Analytics LLC is organised, and disputes are subject to the courts of that state.

If these terms change materially, the revised version is published on this page with a new date. Continuing to buy after a change means the updated terms apply.

16. Contact

Questions about these terms can be sent through the contact form. The Privacy Policy and the Delivery & Refund Policy form part of your agreement with us.
